Terms of use
Preliminary version, pending legal review.
These terms govern your use of Go-Tix, an online ticketing software service provided by Go-Tix (“Go-Tix”). By creating a space, you accept them on behalf of your organization.
The service
Go-Tix lets an organization publish events, sell and issue tickets, check people in, and communicate with its audience. The service is provided “as is”, and evolves over time.
Your account
You confirm that you are authorized to act for your organization and that the information you give is accurate. You keep your credentials confidential and you are responsible for what happens under your accounts, including those you create for colleagues and volunteers.
You are the organizer and the seller
Your organization alone organizes its events and sells its tickets. It is solely responsible for its events, descriptions, prices, taxes, permits, insurance, safety, cancellations, refunds and compliance with applicable laws (including consumer protection and ticket sales rules). Go-Tix is neither the organizer, nor the seller, nor the agent of your organization or of your buyers.
Payments
Payments are processed by Stripe through Stripe Connect. Your organization has its own agreement with Stripe, and the funds are collected directly into its Stripe account. Go-Tix does not hold, transfer or guarantee ticket funds. Refunds, chargebacks, payment disputes and related costs are your organization's responsibility.
Service fee
Go-Tix automatically collects a service fee of $0.75 on each paid transaction (one paid order), at the time of payment. There is no fee on free orders. The fee is not refunded when you refund a buyer. Stripe's processing fees are separate and billed by Stripe. We may change the fee with 30 days' notice by email; the new fee applies to orders paid after that date.
Personal information
Your organization is responsible for the personal information of its buyers, attendees and subscribers. Go-Tix hosts and processes it only on your behalf, to provide the service. You must have a lawful basis to collect it, publish a privacy policy, and respect applicable laws, including Quebec's Law 25, PIPEDA and Canada's anti-spam legislation (CASL) for any message you send. Each organization's data is stored in a separate database. We will notify you without undue delay of any incident affecting your data.
Acceptable use
You may not use Go-Tix for illegal activities, fraud, events that do not exist, misleading offers, hateful or abusive content, or unsolicited messages. We may suspend a space that breaks these rules or puts others at risk.
Availability and your data
We work to keep Go-Tix available but do not guarantee uninterrupted service. You can export your lists (orders, attendees, subscribers) at any time, and you are responsible for keeping the copies you need.
Limitation of liability
To the extent permitted by law, Go-Tix is not liable for indirect damages, lost revenue, canceled events or buyer claims. Our total liability for any claim is limited to the service fees paid to Go-Tix by your organization during the 12 months before the event giving rise to the claim.
Indemnity
Your organization will indemnify Go-Tix against claims from buyers, attendees or third parties that arise from its events, its content or its breach of these terms.
Ending the relationship
You may stop using Go-Tix at any time and ask us to close your space. We may suspend or close a space for breach of these terms. After closure, data is deleted within a reasonable period, except what the law requires us to keep.
Governing law
These terms are governed by the laws of Quebec and the federal laws of Canada that apply there. The courts of the judicial district of Gatineau have jurisdiction. The parties expressly require that the French version prevails in case of discrepancy.
Changes and contact
We may update these terms; we will notify you by email of material changes. Questions: go-tix.com.
